Welcome to the website or mobile application (as the case may be) (collectively, the “Platform”) of Wakawala Sdn. Bhd.  (including its subsidiaries, affiliates, agents, and service providers, collectively, “Wakawala,” “we,” “us,” and/or “our”). This Platform is operated by Wakawala. Wakawala is a full featured fundraising application (‘App’) that provides a seamless and secured platform for Asia and beyond to create campaigns and raise capital. Our online platform is designed to enable users to publish a fundraising campaign, to accept monetary donations and our related services to users and visitors of our services (“you” and/or “your”).

Please review this Privacy Notice carefully before using or submitting any information via or in connection with the Services. You consent to the collection, use and disclosure of your information as set out in this Privacy Notice, using any part of the Services.

INFORMATION THAT WE COLLECT

As described below, when you use or otherwise access the Services, we can collect information in a variety of ways, including by providing information directly to us and gathering data from your device.

  • Information That You Provide Directly to Us:

We collect information from you (including, but not limited to, your name, e – mail address and location) when you provide such information voluntarily, such as when you contact us for queries, provide feedback, register for access to the Services or use certain services

You can also provide us with third – party information, including information stored in your e – mail and mobile device address books, such as, without limitation, names, e – mail addresses and telephone numbers of your contacts (collectively, “third – partydata”).

The collection of information is as described below under THE USE OF INFORMATION COLLECTED. We may not be able to assist/provide you the Services in the event of non-disclosure of information that should be provided to us. We may not be able to proceed further with the Services in the event of non-disclosure of information from you to. You hereby acknowledge and agree that such personal data may be transferred from your current location to the offices and servers of Wakawala if you provide the “personal data”.

We value your opinion and your respectful thoughts whilst using the platform. We reserve our right to remove any content that may be viewed as offensive or inappropriate to others.

  • Information That is Passively or Automatically Collected

Device & Usage Information:

We automatically receive and store some information from your device that you use to access the services upon your interaction with Wakawala. This information is passively obtained using different technologies and includes the type of mobile device you use, your operating system, and may contain location data via an IP address that identifies the city and the state in which you logged on to the platform or your specific geographical location if you allowed your mobile device to provide us with that information.

Such information may be stored by wakawala itself or may be included in databases owned and maintainedby wakawala affiliates or service providers.

Data:
Wakawala may investigates the population demographics, interests and behavior of its customers on the basis of information we collect in an ongoing effort to better understand and serve the users of the Services.

Information of Location:
The Services shall request you to provide the state or province of the campaign when you use the Services to organize a fundraising campaign. Please keep in mind that other users of the Services will be able to view the state or province in connection with the campaign.

Cookies and Other Electronic Technologies:
When you interact with the Services, we try to make that experience simple and meaningful. When you visit our Platform, our web server sends a cookie to your mobile device. Cookies are small pieces of information that are issued to your mobile device when you access or use a mobile application, and that store and sometimes track information about your use of the Platform. A number of cookies we use last only for the duration of your application session and expire when you close you exit the application. Other cookies are used to remember you when you return to the Platform and will last longer.

Some of the cookies used by the Platform are set by us, and some are set by third parties who are delivering services on our behalf. We may use cookies, and similar technologies to cookies, to collect information about your access and use of the Platform. For example, we may use cookies or other technologies that: (1) allow you to navigate and use all the features provided by our Platform; (2) customize elements of the layout and/or content within the Platform and remember that you have visited us before; (3) identify the number of unique visitors we receive; (4) allow us to provide you with a customized experience; and (5) inform us how you use the Platform (including how long you spend on the Platform) and where you have come to the Platform from, so that we can improve the Platform and learn which functions of the Platform are most popular with users. As we adopt additional technologies, we may also gather additional information through other methods.

  • Information From Social Networking Services

One of the special features of the Services is that it may allow you to enable or log into the Services via Facebook and Google (“Social Networking Service(s)”). To log in to our Services, we will ask you to provide your credentials for the relevant Social Networking Service. By adding a Social Networking Services account to the Services or logging into the Services using your Social Networking Services account, we will collect relevant information to enable the Services to access that Social Networking Service and your data contained within that Social Networking Service.

As part of such integration, the Social Networking Service will provide us with access to certain information (including, for example, your name and photograph, as well as other information that you permit the Social Network Service to share with us) that you have provided to the Social Networking Service, and we will use, store, and disclose such information in accordance with this Privacy Notice. However, please remember that the manner in which Social Networking Services use, store, and disclose your information is governed by the policies of such third parties, and Wakawala shall have no liability or responsibility for the privacy practices or other actions of any Social Networking Services that may be enabled within the Services.


You may also have the option of posting your Services activities to Social Networking Services when you access content through the Services (for example, you may post to Facebook that you performed an activity on the Platform); you acknowledge that if you choose to use this feature, your friends, followers, and subscribers on any Social Networking Services you have enabled will be able to view such activity.

TRANSACTION

  1. Campaign Creator/User
    • Basic Campaign
      Wakawala takes Six Per Centum (6%) administration fee and processing fee via Online Banking – FPX 1.0% (TBC) + RM 0.50., Credit Card/Debit Card – Visa/Master is 1.3% (TBC) + RM 0.50, PayPal for Malaysian Donors shall be 3.9% + RM 2.00 and International Donors shall be 4.4% + 0.30 USD.   (excluding government taxes where applicable) for each transaction at the end of the said campaign.
    • Featured Campaign
      Wakawala takes an additional of Nine Per Centum (9%) administration fee and … processing fee via Online Banking – FPX 1.0% (TBC) + RM 0.50., Credit Card/Debit Card – Visa/Master is 1.3% (TBC) + RM 0.50, PayPal for Malaysian Donors shall be 3.9% + RM 2.00 and International Donors shall be 4.4% + 0.30 USD.   (excluding government taxes where applicable) for each transaction at the end of the said campaign should the user opt for featured campaign.

2. Whatever the campaign collected at the end of the campaign duration minus the charges above, will be transferred to campaign creator bank account after Bank Negara clearance. This process will take up to twenty-one (21) working days.

3. If campaign creator fails to comply with Wakawala’s account verification requirements* up to 1 week for individual and 2 weeks for organisation account, before the end of their campaign or Wakawala finds out that the campaign is fraudulent or inappropriate in any manner the campaign collected minus the charges in point A, will be transferred to “Wakawala Fund” for humanitarian aid.

4. No refunds in any transaction.

INFORMATION COLLECTED AND OUR USE

In compliance with this Privacy Notice, Wakawala uses the information obtained from the Services. When you launch a campaign, we can contact you to offer helpful tips or advice about your campaign. For some reason, if you provide data, we may use the information in accordance with the reason why it was given. For example, when you contact us by email, the information you provide will be used to answer your question or solve your problem.

Wakawala may also use the information collected through the Services to help in providing the Services and support services, to process transactions, fulfil request for information, receiving and sending communications, updating marketing lists, analysing data and research aimed at improving the accuracy, effectiveness, usability or popularity of the Services, to personalise the content and advertising that you see on Services and to understand how users interact with and use our advertisement and Services, to associate your activities, customise content or tailor advertising across different devices that you use to access the Services, to comply with laws of Malaysia to enforce our Terms of Service and this Privacy Notice, as otherwise described in this Privacy Notice, or in assisting with other tasks from time to time. Please note that we may combine information that we collect from you and about you (including automatically-collected information) with information we obtain about you from our affiliates and/or non-affiliated third parties, and use such combined information in accordance with this Privacy Notice. We may also use the information collected from the “Information We Collect” section, such as device identifiers to associate users’ activities, customize content, or tailor advertising to those users across different devices.

The data gathered through the Services may be used by Wakawala to contact you about services we think will be of concern to you. We will seek your approval in some instances. We will send you directions in each marketing communication enabling you to “opt out” from obtaining future marketing communications. Furthermore, if you do not wish to receive any future marketing communications at any moment or you would like your name to be removed from our mailing lists, kindly contact us as shown below. If you choose not to receive marketing communications or other data, we believe that you may be interested, as stated below, we may still send you messages about your account or any services that you requested or received from us.

In compliance with applicable laws, we may also use data collected through the Services to submit correspondence related to the Services.For example, we may send periodic emails to registered users of the Services relating to their recent interactions with the Services, such as donating to a campaign or “hearting” a campaign. You accept and consent that you have the permission of the appropriate third party for us to view and use the related third party data and that you have contacted these third parties and notified them of how Wakawala gathers and utilizes their details to provide the Services where, if you use some function of the Services which helps you to connect with third parties (such as recommending a third party to the Services or interacting with them about a project or a donation), either by sending third party information to the Services or otherwise enabling the Services to automatically access third party data in your hands,

We reserve the right to identify you as the person who forwarded any messages sent to you. You accept and agree that we may communicate with you regarding Wakawala by SMS, MMS, text message, or other electronic means to your mobile device. If your mobile phone number is updated or deactivated, you shall immediately update your Wakawala account information to ensure that your messages are not misdirected. Please note that your wireless service carrier’s standard charges, data rates, and other fees may apply where you access the Services through a mobile device. In addition, downloading, installing, or using certain Services on a mobile device may be prohibited or restricted by your carrier, and not all Services may work with all carriers or devices. By using the Services on a mobile device, you agree that we may communicate with you regarding Wakawala by SMS, MMS, text message, or other electronic means to your mobile device . In the event you change or deactivate your mobile telephone number, you agree to promptly update your Wakawala account information to ensure that your messages are not misdirected.

DISCLOSURE OF INFORMATION COLLECTED THROUGH THE SERVICES

There are certain circumstances in which we may share information collected through the Services with certain third parties without further notice to you, as set forth below:

    1. Business Transfers:
      As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution, similar event, or steps taken in anticipation of such events (e.g., due diligence in a transaction), user information may be part of the transferred assets.
    2. Agents, Consultants, Vendors and Related Third Parties:
      Wakawala, like many businesses, sometimes hires other companies to perform certain business-related functions on its behalf, and we may provide access to or share your information with these companies so they can perform services for us. Examples of such functions include marketing, mailing information, data storage, security, fraud preventions, payment processing, legal services and maintaining databases.

       

    3. Legal Requirements:
      Wakawala may access, disclose, transfer and preserve your information when we have a good faith belief that doing so is necessary to: (i) comply with the law including with subpoenas, search warrants, court orders, and other legal process; and respond to inquiries or requests from government, regulatory, law enforcement, public authorities, or content protection organizations; (ii) protect and defend the legal rights, privacy, safety or property of Wakawala, its affiliates, subsidiaries, employees, agents, contractors, or its users; (iii) permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages we may sustain; or (iv) enforce this Privacy Notice or any applicable Terms of Service.

       

    4. Campaign Organisers
      If you donate to a fundraising campaign, we will share your username, your donation message, your country of origin and the amount you donated to the campaign organizer, or you may choose to be anonymous. By donating to the campaign, you consent to our sharing of the above information.
    5. Your consent
      We may share your information in the event you consent to the sharing of your information. For example, we may partner with third party organizations to organize specific campaigns. If you agree to provide your contact information to a specific partner, we may share your name, email address and other information you have provided in connection with your donation to a specific campaign with the partner organization.

       

    6. Aggregate and/or De-Identified Information
      We may aggregate and/or de-identify your information so that the information no longer relates to you individually. Our use and disclosures of such aggregated or de-identified information is not subject to this Privacy Notice, and may be disclosed to others without limitation and for any purpose.
    7. Analytics
      We may use third-party services on our Services. These service providers use the sort of technology previously described in the “Cookies and other electronic technologies” section to help us analyze how users use the Services. The information (including your IP address) collected by the technology will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Services.

      Unsolicited Information

      Please be advised that some information you provide may be publicly accessible, such as information posted in comment sections. We may also collect information through customer support communications, your communication to us of ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, with publicly-accessible information, “Unsolicited Information”). By sending us Unsolicited Information, you further (a) agree that we are under no obligation of confidentiality, express or implied, with respect to the Unsolicited Information, (b) acknowledge that we may have something similar to the Unsolicited Information already under consideration or in development, (c) grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, prepare derivative works, publish, distribute and sublicense the Unsolicited Information, and (iv) irrevocably waive, and cause to be waived, against Wakawala and its users any claims and assertions of any moral rights contained in such Unsolicited Information. This Unsolicited Information section shall survive any termination of your account or of the Services. Otherwise, this Privacy Notice will not apply to any information collected by Wakawala other than information collected through the Services.

Children

Our Services are not designed for use by individuals under the age of 18.

This Privacy Notice applies only to the Services. The Services may contain links to other web sites not operated or controlled by Wakawala (the “Third-Party Sites”). The policies and procedures we described here do not apply to the Third-Party Sites. The links from the Services do not imply that Wakawala endorses or has reviewed the Third-Party Sites. We suggest contacting those sites directly for information on their respective privacy policies.

Security
Wakawala has implemented technical and organizational security measures to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. For example, limiting access to information only to employees and authorized service providers who need to know such information for the purposes of this Privacy Notice. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from the Services may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any information to Wakawala via the Internet.

Retention of your information
For the purpose for which that information was collected and to the extent permitted or required by applicable laws, we will only retain the information for as long as necessary. If we no longer need to use your information, we will remove it from our systems and records and/or take steps to anonymize it to prevent you from being identified from it in accordance with our internal document retention policy.

Access to Information
You may access and correct certain information about you by visiting the “Edit Profile” and “Account Settings” portions of our Platform. You may also request in writing copies of personal information about you held by us. If that information is inaccurate, please let us know and we will endeavor to make the necessary amendments, erase, or block the relevant information as you request.

Changes to Wakawala’s Privacy Notice
From time to time, the Services and our business may change. As a result, Wakawala may sometimes need to make changes to this Privacy Notice. Wakawala reserves the right at any time and from time to time to update or amend this Privacy Notice You may discontinue the use of our Services if you disagree with our revisions to the Privacy Notice. Please review this policy on a regular basis and particularly before you provide us with any information through the Services. After any modifications or revisions to this Privacy Notice, your continued use of the Services will indicate your agreement with the terms of this revised Privacy Notice.
